Career Highlights
A. Paul is an arbitrator and mediator with ADR Chambers and has over 33 years in the construction industry, as a quantity surveyor, commercial manager, consultant, in-house counsel, expert witness, advocate, and third-party neutral in disputes for major contractors and blue-chip owners.
B. Paul qualified as a barrister-at-law, obtaining Call in July 2010, he is a member of the Honorable Society of the Inner Temple and the General Council of the Bar (England & Wales). Paul is also a member of the Toronto Commercial Arbitration Society, the ADR Institute of Canada, and a fellow of the Chartered Institute of Arbitrators. Paul is a Certified Adjudicator in Ontario and Saskatchewan and a Referee for MTO/ORBA, where he has determined numerous files.
C. Paul has negotiated the terms of numerous construction contracts in Europe, China, South America, Australia and the Middle East and has worked on a number of successful claim outcomes (from $500k to $200m) in the UK and internationally, mainly in adjudication, but also in mediation, dispute resolution boards and in arbitration.
D. In 2010, Paul assisted Keating Chambers in arbitration proceedings in Paris, France by providing forensic investigation and the drafting of claims narratives on a $1m dispute relating to design changes due to incorrect FEED information on a pipeline design project in Angola.
E. In 2011, Paul represented a specialist pipeline contractor in Johannesburg in adjudication for a $1.5m claim where he carried out forensic investigations, prepared the claims, and wrote the narratives. Paul also wrote the Referral document, Rejoinder and Appendices, and was advocate in the adjudication process which resulted in a successful award.
F. In 2014, while working for a consultancy in London, England, Paul investigated the defence of the imposition of performance damages on a revamp of a chemicals plant in Aqaba, Jordan. Paul also assisted in the dispute resolution process and provided support for Queens Counsel and solicitors, where he compiled an accepted defence and counterclaim for future negotiation and/or dispute resolution.
G. In 2015, Paul joined Hill International as senior claims manager in Oman, where he was responsible for the review and determination of contractor’s claims on Muscat and Salalah International airports on behalf of the Omani Government. The packages of work included, civil engineering and groundworks for claims in the region of $200m, air traffic management and air traffic control claims in the region of $100m, the baggage handling system for $80m and the passenger boarding bridges for $20m.
H. In 2016, Paul contributed to ‘Introduction Construction Contract Management’ (Routledge) by Mr. Brian Greenhalgh.
I. In 2017, Paul joined Aecon Infrastructure as Commercial Director in Toronto to change the company’s “commercial culture”, where he worked on various LRT projects (in bid and execution) in Toronto, Ottawa and Vancouver.
J. In 2020, for KGC, Paul was appointed to review a Construction Management Contract to produce a report for a condominium development project in Toronto. He also prepared an independent expert report on the veracity of a schedule delay claim on a shopping centre development in Calgary.
K. In 2020, Paul was appointed as an Ontario adjudicator and MTO/ORBA referee, where he has since prepared various determinations in claims for disputes ranging from $10k to $5m.
L. In 2022, Paul was admitted to the roster as a Saskatchewan adjudicator.
